What a late GST return actually costs you
Late fee and interest are two different charges with two different rules — and most businesses overpay the interest because they calculate it on the wrong number.
Miss a GST return by three weeks and two separate charges arrive. They are governed by different rules, and confusing them is what causes businesses to pay more than they owe.
Late fee: a flat daily charge
Late fee accrues per day of delay, whether or not any tax was payable. A nil return carries a much lower daily rate and a much lower cap than a return with outward supply. Both are capped per return, so a very long delay stops accruing at some point — though by then you have other problems.
Interest: only on cash, not on credit
This is the part worth reading twice. Interest under section 50 runs at 18% a year on the tax you actually discharged in cash. Liability settled from your input tax credit does not attract interest.
Businesses that compute 18% on the gross liability routinely overpay, sometimes substantially. If your output tax was ₹5 lakh and ₹4.5 lakh of it was met from credit, interest runs on ₹50,000 — not on ₹5 lakh.
The GST Late Fee Calculator separates the two and shows the day count, so you can check the figure the portal demands rather than accepting it.
The arithmetic
Interest is simple and day-counted: tax × 18% × days ÷ 365. Not compounded, not monthly. A ₹1,00,000 cash liability twenty days late costs about ₹986 in interest, plus the late fee.
What you cannot do
You cannot file the next period until the previous one is filed. Late fee cannot be waived except by a specific amnesty notification, and the portal will not let you proceed until it is paid. There is no general discretion here.
The cheapest fix is structural
Most late filings are not decisions, they are the result of reconciliation taking longer than expected. If your sales data lives in a notebook and your purchase invoices arrive by WhatsApp, the return will always be late. Businesses that file on time usually have billing that produces GST-ready data as a by-product of selling — which is what POS and billing software is for.
If you are already late
- Work out the real interest — on cash-paid tax only.
- File the oldest pending return first; they unlock in order.
- Check whether an amnesty scheme currently applies to your category.
- Fix the cause, not just the return.
